Use of website

  1. By accessing and participating (using), on our social media platform, Y-Nott.com.au, our Website, or any Y-Nott social media pages (“Website”), you accept these Terms and Conditions (“Agreement”) and our various Policies explained on the Y-Nott Website. The “Agreement”, is between you (referred to in this agreement as “you” or “your” referring to you the user of the website) and Y-Nott (referred to in this “Agreement” as “we”, “us” or “our”). We may change any or all terms at any time, changes will be posted on our Y-Nott Website. By continuing to use our Website, you agree that you have reviewed any changes and are informed to the meaning of such changes and acknowledge that by continued use our Website you are bound by any/all changes to the Terms and Conditions (“Agreement”).
  2. Definition of a “user” in this “Agreement,” is someone who accesses, browses, crawls, clicks on content or orders or purchases online or use in any other way permissible our Website.
  3. The user should not use or continue to use our Website, unless you agree, unconditionally, to be bound by these Terms and Conditions. If, you cannot agree to these Terms and Conditions, you are free simply stop using our Website.

Policy- Online store

  1. Y-Nott reserves the option to sell or market its own brand of goods and services from time to time. Y-Nott Website (www.ynott.com.au) is an online market style platform, allowing independent third-parties to make available goods for sale on our Website. The goods being offered on our site if provided from a third-parties facility, these goods, may contain written information containing addition terms and conditions specific to that Sellers goods (such as delivery timetables or method of use etc) and do not vary Y-Nott’s Terms and Conditions.
  2. You agree that you are informed and understand the third-party goods, your choice(s) of goods and Y-Nott is not a party to those choice(s). Y-Nott, as a result of you purchasing goods, we do not control selection of your goods, the listing (advertising) or accuracy or the quality of said goods, or shipping and delivery of the selected goods.
  3. In addition to Terms applicable to goods, we may sell goods direct by Y-Nott as a brand, also these Terms and Conditions set out Terms applicable to goods sold by third-party Sellers.
  4. Y-Nott, endeavours to provide a safe means for the purchaser to transact with Y-Nott and its suppliers, but to the furthest point possible, Y-Nott will remain in control of your personal information, limiting such access to only those details necessary to complete your purchases in a timely manner.
  5. You agree that as our online format made available to you by Y-Nott, is not responsible for any transactions that occur between you and a Third-Party Seller where information on the Y-Nott site is used to make independent contact for such goods. Nor, are we responsible for the Seller’s goods or services to you in any of such purchases, Y-Nott makes no warranty or representation written or implied, regarding the standard of any goods or services supplied outside and not direct as a purchase from Y-Nott, Nothing, in this clause is intended to have the effect of restricting or modify your rights or our obligations that cannot be restricted or modified by law (including the Australian Consumer Law).

Policy- User Registration

  1. Member registration may be necessary to access some features of our Website. If you register, you are providing us with personal information including your name, address, and a valid email address. This information must be accurate and maintained as current.
  2. Use of Y-Nott Website and associated functions, you agree that such use grants your express consent to us and we may from time to time, send you direct marketing communications to the email address you provide, you may unsubscribe at any time.
  3. To register or to use the Y-Nott Website you must be at least 18 years old, have a current Australian residential address and have capacity to enter into a legally binding agreement with us.

  7. Y-Nott may refer fraudulent or abusive or illegal activity to the relevant authorities. If you have an account with Y-Nott, you are solely responsible for any activities relating to the use and what occurs on your account (including orders placed using your account), your account password are not for general distribution amongst third parties, if you choose to allow parties to access, Y-Nott is not responsible for any unauthorised activity on your account, where you fail to keep your account login information secure to you.
  8. You must not, use another member’s account without our, and/or the other user’s, express permission. If you suspect, or become aware, of any unauthorised use of your account or that your password is no longer secure, you must notify Y-Nott immediately and take immediate steps to re-secure your account (including by changing your password).
  9. Y-Nott does not warrant, that the Y-Nott Website will be available at all times and be without disruption and Y-Nott provide no warranties in relation to the content of any other website(s) linked to or from the Y-Nott Website.

Policy- Website Information

  1. Information pertaining goods on Y-Nott Website, is direct material provided by third-party Sellers, Suppliers and/or Product Manufacturers. With exception and as required by law (including the Australian Consumer Law) Y-Nott cannot be held responsible for any inaccuracies or errors caused by a third-party supplying incorrect information to us.
  2. You, as part of your use of Y-Nott Website, agree to make your own enquiries as far as possible to verify the information provided on Y-Nott Website, so you, prior to any and all purchase(s) are fully informed and to ascertain the suitability of goods or services to meet your needs, before you order those goods or services.
  3. You, as part of your use of the Y-Nott Website and further to your enquiries, accept photographic and screen limitations associated with the representation of goods, some actual goods (including, in particular, packaging, clothing, apparel and shoes) may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Y-Nott Website.   5. Any unauthorised access to or use of our secure servers and/or personal information and/or financial information stored on those servers; or
  6. Any interruption or cessation of transmission to or from Y-Nott Website; or
  7. Any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through Y-Nott Website by any third-party; and/or
  8. The quality of any product or service of any linked sites.
  9. Y-Nott, do not in any purchases or transactions warrant, endorse, guarantee or assume responsibility for any product(s) or service(s) advertised or offered by a third-party through the Y-Nott Website or any linked Website or featured in any banner or other advertising.
  10. Y-Nott, where law (including the Australian Consumer Law) provides a guarantee which may not be lawfully excluded, our liability will be limited to that provided by law.
  11. With the exception as required by law, in no event shall Y-Nott, our affiliates and related entities or our suppliers, be liable for any loss or any special, incidental or consequential damages, arising out of or in connection with the Y-Nott Website or this “Agreement” (however arising, including negligence). You in your use of the Y-Nott Website, agree to accept sole responsibility for the legality of your actions under the laws that apply to you. You agree that Y-Nott, our affiliates and related entities or our suppliers have no responsibility for the legality of your actions.

Policy- Indemnity

  1. You will at all times indemnify, and keep indemnified, Y-Nott and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses) or liability incurred or suffered by you or by Y-Nott arising from any claim, demand, suit, action or proceeding by any person against you or Y-Nott where such loss or liability arose out of or in connection with or in respect of your conduct or breach of this “Agreement”.

Policy- Placing Orders

**NB- Your orders for goods that consist of a multiple selections, may on occasions need to be filled from a number of different warehouses in Australia and overseas, when this occurs please be aware that each item maybe treated as individual orders and may arrive at your delivery address nominated at different delivery times or dates, and in these circumstances, deliveries may delay you receiving your complete purchases ordered, you should with all purchases allow a suitable period(s) of time, up to 30 days, from the nominated delivery periods given at time of placing your order(s), are only, a guide to assist you for orders to arrive at your designated delivery address.

NB: ENSURE YOU INSPECT PACKAGING TO OPENING YOUR ORDER, IF THE PACKAGING SHOWS SIGNS OF DAMAGE THAT MAY EFFECT THE GOODS, IT IS NECESSARY THAT PHOTOGRAPHIC EVIDENCE BE SUPPLIED SHOWING BEFORE AND AFTER OPENING PACKAGING AND THEN THE GOODS WITH DAMAGES TO THE GOODS, IF ANY.

  1. You are responsible for any discrepancies or errors in your order, caused by you, where your research has failed to complete or make your selections other than expected.
  2. The promotion of goods or services on the Y-Nott Website, does not, constitute an offer to sell. It is an invitation to treat only.
  3. Orders placed by you are offers to purchase either:
  4. Voucher(s) (where available) for particular goods and/or services, under the “Terms and Conditions” in this “Agreement”, and any third-party Supplier/Seller Terms at the price specified (including delivery and other charges); or
  5. Goods under the “Terms and Conditions” in this “Agreement” at the price specified (including delivery and other charges); or
  6. Goods sold direct, by Y-Nott (if available), or third-party Sellers, are not reserved in-cart, and all or any order(s), are only finalised, when you have completed the checkout process, and then, received an order confirmation from Y-Nott, and your payment in full is received at Y-Nott; or
  7. Following placement of an order for a Sellers goods, we will send the order to the Seller for confirmation, at which time they may accept or reject your order. Where a Seller rejects your order, Y-Nott will refund to you the value of the order and associated shipping charges. You will receive confirmation that your order has been accepted by the Seller, via the email address provided by you, at the time of placing your order.
  8. Fraudulent activities during any transactions, if detected or advised, will result in your order being delayed or cancelled. If your order is detected for potential fraud, Y-Nott will make enquiries prior to further processing of your order. Y-Nott reserves all rights, to subsequently reject and refund your order, at Y-Nott absolute discretion, where fraud is suspected or proven.
  9. Your order will be rejected; Where Y-Nott inquiries believe or has detected a credit card or payment related fraud prior to goods being shipped. Your order may be rejected where your order cannot be shipped for reasons beyond Y-Nott’s Control, or if there has been an error in the price or product description on the Website. In these circumstances and where necessary the order fees will be refunded in full.
  10. You the purchaser, must review your order carefully before proceeding to checkout. Once an order is confirmed, you are unable to cancel or change it. If you have any problems with your order, then you must go through the normal returns process, outlined in this “Agreement”. Please note, for change of mind orders, once an order has been placed and confirmed or you have received the goods at your nominated address, any change or replacement to your order will be at Y-Nott absolute discretion, this discretion, you agree will be less any additional costs incurred by Y-Nott including but limited to a re-stocking charge of 20% of original item cost. You are responsible for all or any additional transport costs incurred. Y-Nott will not change or replace your order where you have made an error in the goods ordered.
  11. In the event that Y-Nott cancels or are unable to fulfil your order, Y-Nott will provide a full refund of any payment received by Y-Nott, via the same method of payment used to complete the original purchase.
  12. Y-Nott, reserves the right, to notify you that goods for which you placed orders, have become unavailable for reasons beyond our control, or your order has been delayed, or Y-Nott cannot fulfil your order for any other reason, you may receive a full refund or store credit, if you so choose.

Policy- Guest Checkout

  1. You are free to make purchases on our Website without creating an account by using our “Guest Checkout”.
  2. When you use “Guest Checkout”, we will collect any personal information you provide, including your name, email and delivery address, in accordance with our “Privacy Policy.”

Policy- Price and Payment

  1. Prices of goods, deliveries and other charges are shown in Australian dollars $AUS.
  2. Total payments must be received, in full, prior to dispatch of any or all goods. If payment from the purchaser is not received, in full, by Y-Nott or is declined by, your bank or credit card issuer, Y-Nott cannot and will not hold items against your order.
  3. If discounts are offered for purchases, a discount code will be issued, the code is only valid for a single transaction, and may not be used in conjunction with any other discounts or transactions.

Policy- Import Goods

If you make contact with Third-party Sellers in overseas countries as a result of viewing those products on our site, Y-Nott is not responsible for your purchases of those goods from such a Seller(s) and the importation of those goods into Australia, may require you to comply with Australian laws and standards that apply to all imported goods.
  2. If you make direct contact with third part sellers as a result of viewing the information on the Y-Nott site. Y-Nott is not responsible for the products purchased from any overseas Sellers through such arrangement or negotiations. Such purchases may exceed the Australian low-value import threshold (currently $1,000AUD). Consequently, your purchases may be subject to additional amount(s) of GST, Australian Customs and the Australian Border Force levee any charges incurred and are not in any way the responsibility of Y-Nott.

Direct Imported Goods

  1. “Direct Import Goods” means, Products which are sourced outside Australia, made available through advertising by third-party sellers on the Y-Nott Website.
  2. “Import Order” means an order for Direct Import Goods.
  3. “Taxes” means any added tax, including GST, all levies, imposts, charges and duties imposed by any authority and the cost of customs clearance in relation to “Direct Import Goods.”
  4. The amount payable by you for “Direct Import Goods” is shown on our Website in Australian dollars, nominated exclusive or inclusive of Taxes as shown.
  5. The cost of shipping and delivery will be charged either inclusive or separately from the price of the “Direct Import Goods”, at the time an Order is made and will be payable at the same time and in the same manner as the Goods ordered.
  6. By placing an Order for Goods, you are deemed to accept these “Terms and Conditions” including the obligations contained in this Policy.
  7. “Direct Import Goods” are sold to you on an Ex Works basis from suppliers. Whereby the risk of ownership and title in the goods passes to you on the date and time these goods are placed at your disposal at the premises or another named place nominated at the time of placing your order for delivery of such goods.
  8. You acknowledge and agree that you will be recorded as the importer of record and will be the responsible party for any Taxes associated with the importation of “Direct Import Goods.”
  9. You acknowledge, that Y-Nott is not liable for any loss, damage, cost or expense that you incur as a result of your obligation to act as the importer of record for the “Direct Import Goods.”
  10. If your Import Order arrives in Australia and the customs value is greater than the “low value import threshold” (currently Aus$1,000, subject to change at any time), you may be required to lodge a Customs Import Declaration and pay the relevant Taxes.
  11. For Australian customs purposes, any number of Import Orders delivered, by Y-Nott to you, may be considered as the one consignment, in which case, the total value of the number of Import Orders will be taken into account in assessing whether the low value import threshold has been reached.

Policy- Store Credits (if available)

  1. Where a in store account exists, unused portion(s) of your Store Credit shall be credited to your account.
  2. To the extent permitted by law, Y-Nott reserves the right to change any of the “Terms and Conditions” in relation to its “Store Credit” upon the provision of reasonable notice, including by notice on the Y-Nott Website.
  3. Store credits when issued, expire after 12 months from the date of issue. Unless otherwise stated in any promotional materials or elsewhere by Y-Nott, store credits when issued for promotional purposes, or otherwise at Y-Nott’s discretion (including for goodwill purposes) will expire after 3 months.

Shipping

Policy- Shipping and Delivery

NB: ENSURE YOU INSPECT PACKAGING TO OPENING YOUR ORDER, IF THE PACKAGING SHOWS SIGNS OF DAMAGE THAT MAY EFFECT THE GOODS, IT IS NECESSARY THAT PHOTOGRAPHIC EVIDENCE BE SUPPLIED SHOWING BEFORE AND AFTER OPENING PACKAGING AND THEN THE GOODS WITH DAMAGES TO THE GOODS, IF ANY.

  1. As part of your purchases we strive to provide to you, the cost-effective method and shipping options, no matter where you live. With each purchase, we seek the most-timely methods to deliver to you your purchases.
  2. The time frame for order delivery is divided into two parts:
  3. Order processing – Once your order is verified, item availability checked. All orders are sent for processing to our warehouse or the manufacturer or suppliers within 1 to 5 working days from order date. Processing orders can take an additional 1 to 5 working days to prepare before despatch.
  4. Shipping/delivery time – Refers to the time items take to reach the purchaser’s nominated delivery address.  Items shipped in Australia, will take between 7-15 working days on average to reach Australian delivery addresses. Remote locations will take longer and the purchaser should allow for such delay. Unforeseen events such as weather occurrences or customs delays or delivery difficulties may affect the timing of your deliveries, refer our forced majeure policy.
  5. Subject to this Agreement, goods will be supplied as shown on your order confirmation. “Confirmations of goods” you have ordered, will be provided to you via email, to the email address provided by you at the time of placing your order.
  6. We endeavour to meet stated timeframes for delivery, however, at various times our shipping service providers may suffer delays, which, such delays are beyond our control. Allow up to 30 days for deliveries.
  7. Standard and Express delivery may be subject to different fees and charges. In addition, certain goods (including bulky items or special orders) may also be subject to additional charges. All shipping charges will be made available to you at checkout or confirmed to you via your “Confirmation of Goods” email or other emails.
  8. Sellers may utilise their own shipping and distribution networks, this may attract different rates or charges for the goods shipped.
  9. Express shipping (at your cost), may be available only in certain areas and for particular orders. Availability of such services and the services cost(s) will be confirmed at checkout or in your “Confirmation of Goods” via email.
  10. You may be required to confirm receipt of all goods at point of delivery, and you are responsible for ensuring you or a proxy is available to accept any delivery(s) and signed for any delivery(s).
  11. Y-Nott will not be held liable for –
  12. Deliveries where an attempt to delivery has occurred, on or before any delivery time-frames or where the delivery is late because any re-attempt to deliver is necessary; or
  13. A parcel that has been signed for at the nominated delivery address, regardless of whether or not you have personally accepted delivery or an authority is given by you to leave the delivery, in any circumstance the order is deemed at that date delivered to have occurred.
  14. Where a courier leaves goods at the nominated delivery site nominated, that date noted by the courier and image if taken, are taken by Y-Nott as order complete and you are responsible for the goods at that point in time.
  15. Y-Nott reserves the right to change, modify or discontinue any delivery options at our absolute discretion.

Policy- Delivery Instructions

  1. **NB You may at the time of check out from Y-Nott online shopping website, if necessary, supply special delivery instructions to us at enquiries@ynott.com.au by email. If no alternate instructions are supplied, you authorise, the courier or delivery service to “leave your delivery” unattended at your nominated delivery address. You accept, if, you or an alternate authorised person, is not available to sign for deliveries, the courier’s date noted for any delivery, is deemed by Y-Nott, that your order is completed and received at that date and your nominated address supplied by you at the time of placing any order.
  2. Couriers do prefer, to hand parcels in person. If nobody is home, the courier or delivery service will always try to find a safe place to leave parcel(s) if size allows, including your letter box. Should the courier for any reason deem the location to be an unsafe to leave the parcel(s) or the delivery address is incorrect, the courier may leave an “attempted delivery card” and return the parcel to their depot. You may contact the courier arranging a place and time to receive delivery.
  3. Y-Nott does not accept responsibility for any loss or damage that results from this delivery process. You agree to release Y-Nott from any and all claims, demands, liabilities, losses, costs and expenses resulting in the delivery process.
  4. Where parcels are returned to Australia Post or any courier’s depot as undelivered for whatever reason, Y-Nott does not take any responsibility for those parcels, especially where, you failed to arrange collection or receipt of those parcel(s). Y-Nott does not cover damages or issue refunds in these cases.

 

Policy- Packaging and Labelling

  1. We have made every effort to display or depict product images as accurately as possible, however, goods to some small extent may differ in appearance or packaging, to the colours and images of the products that appear at the online store. We cannot guarantee that your computer monitor’s display of any colours or images etc. will be accurate.
  2. Y-Nott recommends, you read all labels or instructions provided with the goods purchased prior to use.
  3. Some products are imported or originate outside of Australia, packaging, composition or quality of such products, may vary from the same or similar products available in Australia which were manufactured direct for the Australian market.
  4. Y-Nott does not warrant, that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Website will be corrected.
  5. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where discontinued.

Policy- Tracking Your Parcel

  1. When your order is ready for shipping, an email indicating tracking details (if tracking is available) will be sent to your nominated email address, given by you, at the time of placing any order(s).
  2. Please also check your spam if you have not received tracking updated advice, if necessary contact Y-Nott at enquiries@ynott.com.au for assistance.
  3. Multiple tracking details (if tracking available) may be sent for your order(s) where orders are filled from a number of different suppliers, you may also receive only one tracking number, but multiple parcels from a singular supply source.
  4. You may receive an order that is missing some items ordered, please allow additional time, the items are possibly coming separately. When this occurs allow an additional 21 days over the period already nominated at the time of purchase. In some cases, during events such as covid-19 or similar events, delivery services or transport, may or will cause lengthy delays, allow up to 30 days to receive purchases.

Policy- Returns or Refunds

  • Our policy regarding refunds or returns is in accordance with the Australian Competition & Consumer Commission (ACCC).
  • We are not required to provide a refund or replacement if you simply change your mind.
  • But you can choose a refund or exchange if an item has a major problem. This is when the item:
  • has a problem that would have stopped someone from buying the item, if they had known about the existing problem; or
  • the problem makes the item unsafe to use or operate; or
  • the item is significantly different from the sample depicted or the item’s description; or
  • the item doesn’t do what the manufacturer said it would, or is not what you asked for and can’t be easily fixed.
  • If the problem is not major, and following review at our premises, if warranted we may replace the items or offer a refund.
  • Please note that refunds in relation to shipping/delivery times, will not be issued for orders that arrive within, 30 business days, from the date the order was placed. This is in accordance with the expected shipping times listed on our shipping/delivery policy.
  • Please ensure you keep your proof of purchase until any warranty period expires, these details must accompany any or all claims, e.g. “your receipt” or “order confirmation email.” The purchaser must inspect all goods on receipt of those goods, at the purchaser’s nominated delivery address, for damages to the packaging and or the contents including items ordered. Should such damages be detected by the purchaser observations and a claim for repair or replacement be requested, the purchaser shall provide notification and initial supporting evidence to Y-Nott via email within 72 hours from the date goods received. Note, goods received date is the date the goods are recorded as delivered by a courier or registered mail or noted by tracking as delivered or any other method of showing delivery has occurred to your nominated address.
  • If you are approved for a refund or return, we will provide details and return address, via the email you supplied at time of placing the original order. The purchaser must within 7 days provide tracking details or other method showing goods have been despatched for return to Y-Nott’s address provided to the purchaser for the return items. Y-Nott understands that courier services etc. may be delayed at times, therefore, Y-Nott will allow up to 21 days business day for the returns.
  • Once your return item is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund at that same time.
  • If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 working days.
  • Please allow up to 10 working days for this credit to appear in your account.
  • You will be responsible for paying for your own shipping costs for returning your item to our nominated address. Shipping costs are non-refundable. If you receive a refund, any shipping costs incurred by us for those returns, will be deducted from your refund.
  • Depending on where you live, the time it may take for your exchanged product to reach you may vary, please allow up to 40 working days for this to be completed.
  • If you are shipping an item over $75, Y-Nott suggests you should consider using a trackable shipping service or purchasing shipping insurance. Y-Nott does not guarantee that we will receive any item returned by which ever means returned.

Policy- Change of Mind Returns

  1. The following clause applies to goods that may be sold from time to time directly by Y-Nott. All Sellers, Third-party Suppliers that may advertise with or on the Y-Nott website, may have in their own Terms or procedures differing policies in relation to change of mind returns, Y-Nott does not warrant or hold an opinion on such policies.
  2. Y-Nott, does not refund or exchange goods for change of mind or errors you made in your order. Y-Nott may, at Y-Nott sole discretion, be allowed a return for store credit or product exchange on a case-by-case basis, provided that the item(s) in question is;
  3. Accepted and agreed by Y-Nott prior to any return. The returned item(s) are received by Y-Nott at our nominated address within 7 working days of you receiving the order, and you accept that a 20% restocking fee applies to these returns; or
  4. Has their hygiene integrity and is in re-sellable condition. Y-Nott does accept returns on purchases that have been used or worn or without original tags and/or packaging; or
  5. In a resalable condition; and
  6. Not damaged in any way. or
  7. Not a change of mind return, where items come with packages or boxes where seals are damaged or broken. or
  8. Returned by following the Y-Nott returns process. and
  9. Provided you accept exchange or instore credits are only after we have received and inspected the returned items and a 20% restocking fee is deducted and paid. NB. You are responsible to pay all postage and courier costs incurred in the returns process. Change of mind returns are not accepted for intimates, including underwear, hosiery, socks, swimwear and adult toys for hygienic reasons. Or where original tags or labels have been removed, nor will returns be accepted where laundering, modification or soiling has taken place.

  1. All problem or faulty goods, inquiries to enquiries@ynott.com.au detailing your complaint to us via email. Y-Nott, will investigates any issues, advising whether your purchases are to be returned and where to return to. We will take-up your complaint with the supplier, there may be a need to return the purchases direct Y-Nott will assist.
  2. Goods purchased Direct from independent or third-party Sellers, where these sellers were contacted after reviewing the seller’s details on the Y-Nott website. In these purchases the onus is and remains wholly your own and those reseller’s responsibility. Y-Nott does not provide any such warranties or assistance to resolve these purchases.
  3. Goods, with valid manufacturer warranty purchased through our Y-Nott site, that may still be faulty. Y-Nott recommends you first contact Y-Nott via our website at enquiries@ynott.com.au detailing your complaint with evidence, we will investigate then advise you of the steps to remedy the complaint.
  4. Return goods, will be inspected, your emailed claims and details provided of faulty goods are investigated. If, defects are substantiated, the goods, may be returned to third-parties for assessment and/or alternatively repaired locally.
  5. Y-Nott, in Y-Nott absolute discretion, may conclude that your claim does not warrant a remedy following inspection by Y-Nott or third-party or independent Suppliers of your goods. For example, where it is believed the goods have been misused, or there was a failure by you to use the goods in accordance with manufacturer’s instructions, or the goods were used it in an abnormal way, or there has been a failure to take reasonable care in any use. Y-Nott, will advise you if your claim(s) have been rejected, and return your goods to you. You, are required to cover all shipping costs associated with the return of the goods after inspection to you, where, a claim(s) have not been substantiated.
  6. Where, repair or replacement of goods is not practical, any refund(s), will be issued to the purchaser, using the payment method used for the initial purchase. If, the purchaser, has an instore account with Y-Nott, instore credits will be issued to the purchaser’s account, used initially to purchase the goods.
  7. Y-Nott, aims to process any refunds and/or replacement of goods, within 14 working days of receiving original goods at the nominated place of inspection. Once a claim(s) is substantiated, however, depending on your item and the number of returns being processed, this may take longer.
  8. In the case of goods and/or services through Independent or third-party providers where, Y-Nott was not party, to those goods or services purchased by you, and where, Y-Nott in its sole discretion has acted to assist but has a refusal of refund, this does not, prevent you from seeking negotiations for refund directly from the provider involved in the providing of those goods. Y-Nott Does not provide warranties or other relief in such dealings.

A Purchaser (you), are entitled to seek replacement for, or refund for, a major failure and compensation for, any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced, if the goods, fail to be of acceptable quality and the failure does not amount to a major failure.
  2. Any goods with a nominated warranty provided by Y-Nott, will apply in addition, to other rights and remedies you may have under the Australian Consumer Law. Where applicable, you may make a claim in relation to goods that are faulty in accordance with Y-Nott warranty (warranty provided at the time of purchase). This warranty only applies where advertised in the product’s listing for individual goods.
  3. Goods that you purchase from the Y-Nott site, may contain warranty documents, on or inside, the packaging provided by the manufacturer of such products. Any such warranty documents or content of those warranties, are not given by Y-Nott, and rights you may have in relation to those warranties are completely separate to any warranty rights given to you by Y-Nott. Some warranty documents provided by manufacturers of imported goods may not apply in Australia.   1. This warranty is given by Y-Nott (“Warrantor”) and applies only to products where the Y-Nott, twelve-month warranty against defects is expressly given in the product listing on the respective website.
  2. The Australian Consumer Law provides certain guarantees to consumers when they purchase goods and these guarantees cannot be excluded, restricted or modified. These consumer guarantees are different to, and separate from, this warranty, which is given voluntarily by the Warrantor. Subject to the Terms and Conditions of Y-Nott warranty, where your goods are defective within 12 months of your purchase, the Warrantor agrees to repair the goods, provide you with a replacement or a refund for the full amount of the purchase price (in the event that it is not possible to repair the goods or a replacement is unavailable).
  7. The applicable warranty period (12 months), commences on the date, that the product is delivered to your nominated delivery address and verified. Alternatively, where no proof of delivery is available, the applicable warranty period will commence, on the date, the tracking number or advice nominates the purchased goods have arrived at the delivery address nominated by you.
  8. Y-Nott sells, among other things, clearance goods. Clearance goods are new, but of limited quantity or are a product for whatever reason will not form part of a in stock list and available for sale. If such products are offered for sale at clearance sales, choose and inspect carefully, warranty or refunds for clearance items are not available. We will make all reasonable endeavours to repair or replace your product as a warranty item without obligation.

  5. where goods are damaged or defective upon delivery, you must within 72 hours, provide photographic evidence of the damage to the packaging, prior to opening such packaging, and photographic evidence, then, of the damage to the purchased goods.   9. if any returned goods, are found to be in good working order, we may seek reimbursement, at our discretion, for any costs incurred by us in relation to such goods. In such cases, you agree that we may hold your goods until such payment is received; and
  10. Except as required by law (including the Australian Consumer Law), this warranty shall not apply in respect of goods:
  11. where the goods have not been installed, maintained, operated or used in accordance with the manufacturer’s instructions or any other specifications provided with the goods; and

  15.  in relation to batteries and repairs, where the batteries have not been used in accordance with specifications or the batteries has expired the use by date of the batteries or the batteries has expired by normal use.
  16. Except as required by law (including the Australian Consumer Law), our liability under this warranty, shall not exceed, the original amount paid at the time of original purchase. That is, the price for the goods or the replacement of the goods, whether the same or a similar product, will not exceed the original purchase price paid by you.
  17. In the event that storage media (such as hard disc drives) ordered from us, becomes faulty, fails or otherwise detrimentally affects other or all software or data stored on it, except as required by law (including the Australian Consumer Law), we will not be liable for any loss or damage to the software or data, however arising.
  18. Your own practise, should maintain a backup of all software and data stored on your devices. If you return media (such as a hard disc drive), whether separately or as a part of a larger electronic or computing product, to us for any reason, including for replacement or repair, we will not be responsible for any software or data stored on the media. We make no representation that we will be able to repair or replace any product without risk to or loss of the software or data.

General

  1. Y-Nott will not be liable for any delay in performing any of our obligations under this Agreement, if, any such delay is caused by circumstances beyond our reasonable control.
  2. This Agreement will be governed by and interpreted in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of the State of New South Wales, Australia.
  3. If any part of this Agreement is found to be void, unlawful or unenforceable, then that part will be deemed to be severable from the balance of this Agreement, and the severed part will not affect the validity, and enforceability, of any remaining provisions.
  4. If Y-Nott does not, exercise or enforce any right or provision under this Agreement, it will not constitute a waiver of such right or provision. Any waiver of any provision under this Agreement, will only be effective, where it is in writing and signed by the Management of Y-Nott.
  5. Indemnification – You agree to indemnify, defend and hold harmless Y-Nott and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and conditions or your violation of any law or the rights of a third-party.

Forced Majeure

** NB. Force Majeure, Y-Nott shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Y-Nott, and Y-Nott shall be entitled to a reasonable extension of time for the performance of any such obligations.

Such events that are a result in a Forced Majeure whether in Australia or International, is as a result of Acts of God, including but limited to fires, floods, earthquakes, storm, hurricane or other natural disaster such as pandemics, financial collapse or acts of foreign hostilities, civil unrest, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity.

Y-Nott will not be liable to any failure, delay, or disruption of telecommunications services, consequently effecting the Y-Nott web sites, online or associated services, online banking and goods tracking or any other informational services associated, caused by a Force Majeure Event.
